Data Retention Policy

This Data Retention & Deletion Policy ('Policy') outlines the procedures and principles governing how Ofilix Technology ('Ofilix,' 'we,' 'us,' or 'our'), the developer of the TAMS platform, manages the retention, storage, and deletion of data collected from its users ('User,' 'you,' or 'your'). This Policy is an integral part of our Privacy Policy and Terms of Service. By using the TAMS Services, you acknowledge that you have read, understood, and agree to the terms of this Policy.
1. Principles of Data Retention
We are committed to a policy of data minimization. We will only retain your data for as long as is necessary to fulfill the purposes for which it was collected, including:
Providing the Services you have subscribed to and managing our business operations. Complying with our legal, tax, accounting, and regulatory obligations. Resolving disputes, enforcing our agreements, or protecting our legitimate business interests.
2. Retention of Active Account Data
Active Accounts: All data associated with an active TAMS account, including church, member, financial, and administrative records, is securely stored and maintained for the duration of the active subscription period. You have full control over this data, including the ability to add, edit, or delete it at any time while your account is active.
3. Deletion of Data After Account Termination
Post-Cancellation Grace Period: Following the cancellation or termination of your TAMS subscription, we will retain your data for a grace period of ninety (90) days. This period is provided to allow for potential account reactivation, which can be done seamlessly without data loss.
Permanent Deletion: Upon the expiration of the 90-day grace period, all data associated with your account, including all church, member, and financial records, will be permanently and irreversibly deleted from our active production systems. This process is designed to be thorough and cannot be reversed.
4. Backup Data Retention
Backup Systems: Data from deleted accounts may persist in our encrypted backup systems for a period of up to one hundred and eighty (180) days after its deletion from our active production systems.
Purpose of Backups: These backups are maintained solely for disaster recovery purposes. They are not used for any operational, analytical, or commercial activities. The data within these backups is inaccessible to TAMS personnel, except in a limited, controlled, and secure manner required for data restoration in the event of a catastrophic system failure. Backups are automatically and progressively overwritten on a rolling basis.
5. Financial and Legal Records
Extended Retention: Notwithstanding the above, certain information, particularly financial records (e.g., invoices, transaction details) and billing information, may be retained for an extended period of up to seven (7) years or as otherwise required by applicable tax, accounting, and financial laws in Nigeria and other relevant jurisdictions.
Purpose: This extended retention is mandatory for compliance with legal obligations. These records are stored in a secure, isolated environment and are not used for any other purpose.
6. User-Initiated Deletion Requests
Right to Erasure: As a user, you have the right to request the immediate deletion of all data associated with your account at any time.
Procedure: To request immediate deletion, you must submit a formal request via email to support@tamshq.com. We may require identity verification to confirm that the request is from an authorized account holder.
Response: We will process your request and confirm the permanent deletion of your data from our active systems within thirty (30) business days, unless a longer retention period is required by law (as per Section 5) or for the reasons stated in Section 7.
7. Exceptions to Deletion
We may be required to retain certain information for longer than the periods specified above in the following limited circumstances:
- Legal Compliance: To comply with a subpoena, court order, or other legal process.
- Fraud and Security: To investigate, prevent, or address fraud, abuse, or security incidents.
- Enforcement of Rights: To enforce our Terms of Service, defend against legal claims, or protect our rights and property.
8. Policy Updates
We reserve the right to amend this Policy at any time. We will notify you of any significant changes by posting the updated Policy on our website or through other direct communication channels. Your continued use of the Services after such notification constitutes your acceptance of the revised Policy.
